Maintaining compliance for wheelchair accessible minibuses is essential for ensuring the

providers have a clear responsibility to meet strict regulatory standards when transporting

Passenger Safety
At the heart of compliance is passenger safety. Wheelchair accessible vehicles must be
properly equipped with approved restraint systems, including wheelchair tie-downs and
occupant seatbelts that meet recognised safety standards such as ISO 10542. These systems
must be correctly installed, regularly inspected, and used appropriately by trained staff.
Inadequate securing of a wheelchair can lead to serious injury in the event of sudden
braking or collision, making routine checks and staff competence critical.
The Equality Act 2010 is a key piece of legislation governing accessible transport. It requires
service providers to make reasonable adjustments to ensure disabled passengers are not
disadvantaged. This includes providing safe access via ramps or lifts, ensuring sufficient
space for wheelchair users, and training staff to assist passengers respectfully and
effectively.
Compliance
Vehicle condition and roadworthiness are regulated by the Driver and Vehicle Standards
Agency (DVSA). Wheelchair accessible minibuses must undergo annual MOT testing, and six-
monthly LOLER tests for any electric ramps if installed. Other maintenance checks will cover
ramps and winches where a lift is not installed, and all securing equipment. We will support
you in keeping the required detailed maintenance records as evidence of compliance.
As well as ensuring that recommended service schedules are adhered to, we’ll also take care
of any maintenance highlighted in the MoT, plus replace tyres where needed. We can also
assist with other compliance matters such as ancillary product packs that include in-date
first aid kits, fire extinguishers, warning triangles, replacement straps, and hi-vis vests.
Your drivers
Driver licensing and operational rules are equally important. Anyone with a full UK licence
gained prior to January 1997 can drive a minibus up to 16 seats. Anyone who gained a
standard category B car licence after this time can drive a minibus of up to 9 seats – if they
are over 21 years of age, have had a driving licence for at least 2 years, and if over 70 years
of age meet the ‘Group 2’ medical standards. Although care home minibuses are not for
commercial use, in that they are not for hire, all drivers must be appropriately trained in
passenger safety, including the correct use of accessibility and safety equipment.
